Terms & Conditions of Use
These terms and conditions govern the use of the electronic version of the trade finance application (“the application”) provided online by the Arab Trade Financing Program (“ATFP”) and designed according to schedule “A” in the ULOC agreement duly signed between ATFP and the National Agency. The National Agency agrees that those terms and conditions may be further supplemented and amended by ATFP online without prior written notice.
1. Authorized person(s) / application users
The National Agency shall, through a registration procedure, furnish ATFP with a list of authorized person(s) appointed by the National Agency, who is/are authorized to electronically enter the application for financing data into the application provided online by ATFP. The National Agency undertakes to inform ATFP immediately regarding any changes (if any), in the list of authorized person(s) to use the application platform.
2. Access to the application platform
Access to the application platform on the internet is restricted to the authorized personnel named by the National Agency of which ATFP has created access rights on its database servers. Authorized personnel shall only access the application from the ATFP website represented by https://www.atfp.org.ae or any gateway named by ATFP administration thereafter. Furthermore, authorized personnel at the National Agency shall only use the computer devices connected to a protected and secured IT network at their place of work.
3. Login information
National Agency shall not share the login information pertaining to the application and the inbox of the official email of the National Agency to which OTP is sent, with any third party other than the National Agency. In the event of a security breach that might jeopardize account login information, authorized personnel at National Agency should immediately notify ATFP administration.
4. Security Procedures
The National Agency shall comply with the security procedures and any other reasonable instructions ATFP may issue in respect of the usage of the application. Notwithstanding the foregoing, it is the responsibility of authorized personnel, at the National Agency, to safeguard the account login information to the application platform.
5. Service interruption
ATFP does not warrant that this online service will be available and meet your requirements, that access will be uninterrupted, that the service will not be hacked or subjected to unauthorized access, that no viruses or other contaminating or destructive properties will be transmitted to your devices accessing the application. You have sole responsibility for adequate protection, and back up of data, and/or equipment, and to undertake reasonable security measures and appropriate precautions to scan for adware, malware, computer viruses or other destructive properties.
6. Data use and Confidentiality of information
ATFP will rely on the fed data to process the offer for financing to the National Agency. All data / information contained in or fed into this application and its uploaded attachments are recognized and dealt with as confidential and will only be used by ATFP for authentication purposes. Neither party shall disclose any information to any third party.
7. Suspension and termination
ATFP reserves the right to suspend the National Agency’s right to use the application provided online immediately, permanently or temporarily, for any reason and without prior notice to the National Agency. In the event of such suspension, the National Agency may request reinstatement of the services by contacting ATFP in kind. ATFP reserves the right in its sole discretion to grant or deny reinstatement of the National Agency to use the application. Furthermore, in the event where the relationship between the National Agency and ATFP is terminated, ATFP shall be entitled to cancel all access rights given to National Agency to use the application.
8. Amendments and cancellation
ATFP reserves the right to modify, amend or cancel any of these terms and conditions of use without reverting back to any party and the National Agency shall refer to the updates from time to time.
9. Copyright
All intellectual property rights (if any) on ATFP website belongs exclusively to ATFP and cannot be violated in any way. Otherwise, the violator shall be subject to legal due process according to the violation, without prejudice to the right of ATFP to suspend the online service for the violator.
10. Validity of application
Any electronic application received online via the platform is considered as valid application issued by the National Agency and a product of its will, irrespective of the identity of the sender, whether or not it is by an authorized user, and the National Agency is committed to the results of the application accordingly.
Disclaimer and Limitation of Liability
This website is owned and operated by ATFP. By using this website, whether browsing or opening an application, you acknowledge that you have read and understood the terms and agree to be bound by them. Whilst ATFP has taken reasonable steps to ensure the accuracy, availability of this online service represented by the application, ATFP does not accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information processed by the application. The use of this application is at the National Agency’s sole risk. ATFP shall not be liable for any losses or damages or expenses (including legal costs) whatsoever arising out of the use of this application, even if ATFP has been advised of the possibility of such damage.
